Terms of Service

Important: By using the Soundate application, the User expressly accepts the provisions set forth in these Terms of Service, including the rules regarding objectionable content, moderation, and data processing. Please read this document carefully before registration! You must provide explicit consent before registering or first using the application.

1. General Provisions

1.2. Nature of Service

Soundate is a voice-based dating mobile application that enables users to build connections with each other through sharing voice messages, text messages, and images.

1.3. Contract Formation and EULA Acceptance

These terms of service constitute the contract between the User and the Provider. The contract is formed upon completion of registration, when the User expressly accepts these terms. During the registration process, the User must actively approve these Terms of Service (e.g., by checking a checkbox) before the account can be created. Registration cannot be completed without explicit acceptance of these terms.

2. Eligibility and Registration

2.1. Age Requirement

Important Restriction: The Soundate application may only be used by persons who have reached the age of 18. By registering, you declare and warrant that you are at least 18 years old. If we become aware that a person under 18 has registered, we will immediately delete their account.

You may use the Soundate application only for personal, non-commercial purposes. The purpose of the application is to establish genuine human connections.

We do not perform automatic content moderation, but:

Moderation commitment: After a report of inappropriate content or behavior is filed, the Provider will review the case within 24 hours and take appropriate action, which may include content removal, temporary suspension, or permanent deletion of the user's account. The User acknowledges that severe or repeated violations may result in permanent ban without prior warning.

4. Intellectual Property

4.1. Soundate's Intellectual Property

The application, its design, logo, code, and all other elements are the exclusive intellectual property of the Provider. It is prohibited to:

For detailed information on the processing of your personal data, please refer to our Privacy Policy. By using the application, you accept our data processing practices.

Location data usage: Certain features of the application (e.g., distance-based search and suggested matches) may use location data. The User consents to this by accepting the data processing policy. The core features of the application — including profile creation, voice introduction recording, swiping, and chat — are fully accessible without enabling location services. Without location data, distance-based filtering will not be available, but the User may manually enter their location.

Important Note: While we make every effort to protect your data, do not share financial information, passwords, or overly personal data with other users. Be cautious when meeting unknown persons!

6. Matching and Communication

6.1. Match Creation

A match is created between two users when both like each other. In case of a match, both parties can send messages to each other.

6.2. Messaging

After a match, the following communication forms are available:

Message Retention Policy: All messages (voice messages, text messages, and images) are automatically and permanently deleted 180 days (6 months) after sending. This deletion cannot be undone and applies equally to all message types. After deletion, the conversation will display "There are no messages from the last 180 days in this conversation."

Either party can end a match (unmatch) at any time, in which case:

The account deletion option is directly accessible within the application's settings. You can delete your account at any time in a few steps. Deletion:

If your account remains inactive for 2 years, we will automatically delete it. We will notify you by email 30 days before deletion.

10.1. Free Service

The basic Soundate service is free to use. Registration, recording a voice introduction, browsing profiles, liking (with daily limits), matching, and the basic chat features are all available free of charge.

The Soundate Premium subscription provides additional features, including:

The subscription is available for the following periods:

Pricing: Current prices for each subscription plan are displayed within the application on the purchase screen, as well as in the Apple App Store and Google Play Store, prior to purchase. Prices may vary depending on the user's region and currency, and include any applicable local taxes.

10.3. Lightning Voice

Lightning Voice is a one-time (non-subscription) purchasable item that allows you to send a voice message to another user without having a match. Lightning Voice packs are available in the following sizes:

Lightning Voices are consumable purchases: once used, they cannot be restored, and they do not expire.

10.4. Automatic Renewal and Cancellation

The Soundate Premium subscription automatically renews at the end of the chosen period (every 1, 6, or 12 months) unless the User cancels at least 24 hours before the end of the current period.

How to cancel:

Cancellation does not take effect until the end of the current subscription period — premium features remain accessible until then. The subscription cannot be cancelled within the Soundate app itself; it can only be managed through the device settings or the respective app store.

10.5. Payment Processing

All purchases (both subscriptions and Lightning Voices) are processed through the Apple App Store or Google Play Store payment systems. The Provider does not directly handle bank card or payment details. The purchase amount is charged upon confirmation to the payment method associated with the user's Apple ID or Google account.

10.6. Refunds

Refunds for purchases are handled by Apple and Google according to their respective refund policies:

The Provider is not authorized to issue refunds directly for purchases made through the app stores.

10.7. Restoring Purchases

If you switch devices or reinstall the application, you can restore your subscription and previous non-consumable purchases using the "Restore Purchases" feature within the application. Consumable purchases — such as Lightning Voices — cannot be restored after use.

10.8. Price Changes

The Provider reserves the right to modify subscription and other purchase prices. In case of a price change:

If you have a complaint about the service or another user:

We primarily seek to resolve disputes arising from these terms amicably. If this is not possible, the competent Hungarian courts shall proceed under Hungarian law.

12. Other Provisions

12.1. Modification of Terms

We reserve the right to modify these terms of service at any time. Regarding significant modifications:

These terms of service and the use of the service are governed by the laws of Hungary.

12.3. Severability

If any provision of these terms proves invalid or unenforceable, it shall not affect the validity of the remaining provisions.

12.4. Assignment

The Provider is entitled to assign its rights and obligations under this contract to a third party. The user may not assign their rights or obligations.

12.5. Entire Agreement

These terms of service and the Privacy Policy together constitute the entire agreement between the parties.

13. Apple App Store Terms

The following terms apply to the use of the Application when downloaded from the Apple App Store. These terms are required by Apple Inc. and supplement the rest of this agreement.

13.1. EULA Parties

This End User License Agreement (EULA) is concluded between You and the Provider (Csordás Zoltán E.V.) only, and not with Apple Inc. ("Apple"). The Provider, not Apple, is solely responsible for the Application and its content.

13.2. License Scope

The Provider grants You a non-transferable license to use the Application on any Apple-branded device that You own or control, as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions. This license also allows family members who share through Family Sharing or volume purchasing to use the Application.

13.3. Maintenance and Support

The Provider is solely responsible for providing any maintenance and support services with respect to the Application, as specified in this EULA or as required under applicable law. Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the Application.

13.4. Warranty

The Provider is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the Application to conform to any applicable warranty, You may notify Apple, and Apple will refund the purchase price (if any) for the Application. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Application, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be the Provider's sole responsibility.

13.5. Product Claims

The Provider, not Apple, is responsible for addressing any claims You or any third party may have relating to the Application or Your possession and/or use of the Application, including but not limited to: (i) product liability claims; (ii) any claim that the Application fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.

13.6. Intellectual Property Claims

In the event of any third-party claim that the Application or Your possession and use of the Application infringes that third party's intellectual property rights, the Provider, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.

13.7. Legal Compliance

You represent and warrant that: (i) You are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) You are not listed on any U.S. Government list of prohibited or restricted parties.

13.8. Third-Party Terms

You must comply with applicable third-party terms of agreement when using the Application (e.g., Your wireless data service agreement).

13.9. Apple as Third-Party Beneficiary

Apple, and Apple's subsidiaries, are third-party beneficiaries of this EULA, and upon Your acceptance of the terms and conditions of this EULA, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against You as a third-party beneficiary thereof.
